Terms & Conditions

Payment, Refund & Credit Policy

These Terms & Conditions (“Terms”) govern all consultations, treatments, programs and packages purchased from Chiro Health Vision (“the Clinic”, “we”, “us”, “our”). By booking an appointment, making a payment, or receiving treatment, you (“the Patient”, “you”, “your”) agree to be bound by these Terms.

1. Definitions

Clinic means Chiro Health Vision Pty Ltd, its practitioners, staff and any successor practice.

Patient means the person receiving or booking to receive treatment, or, where applicable, the parent or guardian booking on behalf of a minor.

Program / Package means a prepaid bundle of consultations, treatments or services purchased in advance.

Credit means the unused monetary value of a Program or Package that remains available to the Patient for future use, as described in Section 4.

Change of Mind means a decision by the Patient not to proceed with, or to discontinue, a paid service for any reason other than a failure by the Clinic to provide services with due care and skill.

2. Fees & Payment

2.1  All fees are payable at the time of booking or at the time of service, unless a payment plan has been agreed with us in writing.

2.2  Program and Package prices are fixed at the time of purchase and cover the specific services described in your treatment plan.

2.3  Prices are subject to change from time to time; any change will not affect services already paid for in full (see Section 8).

3. Refunds

3.1  Fees paid for consultations, treatments, Programs or Packages are non-refundable, including where a Patient:

(a)  changes their mind about proceeding;

(b)  decides to discontinue a Program or Package part-way through; or

(c)  does not use the full value of a prepaid service within the applicable period.

3.2  This policy is provided to you prior to payment. Where you book an appointment through our online booking system, you must expressly accept these Terms before your booking can be confirmed. Your acceptance of these Terms, together with your subsequent payment, constitutes your informed agreement to this policy (see also Section 18).

3.3  No statutory cooling-off period applies to services purchased in person or during a consultation at our Clinic, except where required by law.

3.4  This policy exists because your booking and prepayment reserve dedicated clinical time, equipment and resources for you that cannot always be reallocated at short notice.

3.5  Nothing in this Section 3 excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded under the Australian Consumer Law (for example, your right to a remedy if a service is not provided with due care and skill). This policy addresses only refunds sought for Change of Mind and does not limit those separate rights.

Your unused balance is protected as Clinic Credit Any prepaid amount not yet used remains available to you as Credit toward future consultations, treatments or services at Chiro Health Vision (see Section 4). Credit is not lost — it is simply held for your future use.

4. Clinic Credit

4.1  Credit arising from an unused prepaid balance may be applied to any service offered by the Clinic.

4.2  Credit is valid for 12 months from the date of purchase unless otherwise agreed in writing, and is non-transferable to another person or account.

4.3  To apply Credit to a future booking, please advise reception prior to or at the time of booking.

4.4  Credit balances are recorded on your patient file and available to you on request.

4.5  Your booking, and any Program or Package you purchase, is personal to you and may not be transferred, gifted or used by another person without our prior written agreement.

5. Cancellations & Missed Appointments

5.1  We require at least 8 hours’ notice to cancel or reschedule an appointment.

5.2  Cancellations made with less than 8 hours’ notice, or missed appointments (“no-shows”), may forfeit 50% of the value of that session.

5.3  Repeated late cancellations or no-shows may affect your ability to book future appointments.

6. Exceptional Circumstances

6.1  Where a documented medical condition prevents a Patient from continuing treatment, the Clinic may, at its discretion, consider alternatives to the standard policy in Sections 3 to 5, including an extended Credit period. Requests should be made in writing to the Clinic Director together with supporting documentation.

6.2  Where we agree, at our discretion, to provide a refund in circumstances where you are not otherwise entitled to one under these Terms, we may retain up to 20% of the amount paid to cover administration and processing costs.

7. Patient Responsibilities

7.1  Please disclose all relevant medical history and any change in your health status prior to treatment.

7.2  Treatment outcomes vary between individuals; the Clinic makes no guarantee of a specific clinical result.

7.3  You must not record, photograph or otherwise capture consultations or treatment sessions without our prior consent.

8. Changes to These Terms

8.1  We may update these Terms from time to time, including changes to pricing, the Credit validity period, or clinic policies.

8.2  Where a change is material, we will notify you by email or by posting the updated Terms at the Clinic at least 14 days before it takes effect.

8.3  Continued use of our services after a change takes effect constitutes acceptance of the updated Terms. Services already paid for in full prior to a change will not be affected by that change.

9. How We Will Contact You

9.1  We will generally contact you by email, SMS or phone using the details you have provided to us.

9.2  You must notify us promptly of any change to your contact details. We are not responsible for any failure to reach you if your details are out of date.

10. Complaints & Dispute Resolution

10.1  If you have a concern about your treatment, an invoice, or these Terms, please contact the Clinic directly in the first instance at alan@chirohealthvision.com or 02 8413 8531.

10.2  We aim to acknowledge complaints within 5 business days and resolve them promptly and fairly.

10.3  If a complaint cannot be resolved directly with the Clinic, you may escalate it to the NSW Health Care Complaints Commission or the Australian Health Practitioner Regulation Agency (Ahpra), as applicable.

11. Limitation of Liability

11.1  To the extent permitted by law, the Clinic’s liability for any loss or damage arising from these Terms or our services is limited to the value of the service giving rise to the claim.

11.2  The Clinic is not liable for any indirect or consequential loss.

11.3  Nothing in this Section 11 limits any liability that cannot lawfully be excluded, including under the Australian Consumer Law or our professional obligations as registered health practitioners.

12. No Waiver

Our failure or delay in enforcing any part of these Terms does not waive our right to enforce it later. A single or partial exercise of a right does not prevent us from exercising it, or any other right, again.

13. Assignment

We may transfer or assign our rights and obligations under these Terms (including any Credit balance obligations) to a successor practice, for example in the event of a sale or merger of the Clinic. This will not affect the value of any Credit you hold.

14. Severability

If any provision of these Terms is found to be invalid or unenforceable, that provision will be read down or severed to the extent necessary, and the remaining provisions will continue to apply.

15. Force Majeure

15.1  We are not responsible for any delay, interruption or failure to provide services caused by circumstances beyond our reasonable control, including natural disasters, pandemics, government restrictions, power or technology failures, or other events beyond our reasonable control.

15.2  Where reasonably possible, we will take reasonable steps to reschedule affected appointments or provide an alternative arrangement.

16. Privacy

16.1  We collect and hold your personal and health information to provide and manage your care, in accordance with the Australian Privacy Principles under the Privacy Act 1988 (Cth).

16.2  We do not share your information with third parties without your consent, except where required by law or necessary to provide your care (for example, referrals).

16.3  You may request access to, or correction of, the personal information we hold about you by contacting our Privacy Officer at alan@chirohealthvision.com.

17. Governing Law

These Terms are governed by the laws of New South Wales, Australia, and the courts of that State or Territory have exclusive jurisdiction over any dispute arising from these Terms.


18. Acknowledgment

By booking an appointment (whether online or by other means) and by proceeding with payment, you confirm that you have read, understood, had the opportunity to ask questions about, and agree to these Terms & Conditions, including the refund and credit policy in Sections 3 and 4.

Where you book through our online booking system, your acceptance of these Terms is recorded electronically at the time of booking, before your appointment is confirmed. This electronic acceptance has the same effect as a signature for the purposes of these Terms.

Where these Terms are provided to you by email or via this link prior to your first appointment, no further action (such as clicking a button on this page) is required for them to apply. Your decision to proceed with booking an appointment or making payment after receiving these Terms constitutes your acceptance of them.
